Terms of Service

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of DialYourCalls ("the Platform"), a business communications service provided by Bubba Nugget Technologies LLC. By accessing or using the Platform, you agree to be bound by these Terms.

Account Registration and Security

To use our Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Notify us immediately of unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account.

Acceptable Use Policy

You agree NOT to use the Platform to:

  • Send spam or unsolicited messages
  • Send messages without proper recipient consent
  • Violate TCPA, CAN-SPAM, or telecommunications regulations
  • Transmit illegal, harmful, or offensive content
  • Impersonate others or misrepresent your identity
  • Use the Platform for phishing, fraud, or scams

Violation may result in immediate account termination.

Export Control and Sanctions

Our services are subject to U.S. export control and OFAC sanctions.

You may NOT use our services if you are:

  • Located in Cuba, Iran, North Korea, Syria, or Crimea
  • On the OFAC SDN List or Commerce Denied Persons List
  • Conducting business on behalf of sanctioned entities

Violation may result in criminal prosecution, civil penalties up to $330,947 per violation, and asset forfeiture.

Geographic Limitations

Our services are currently available only to customers located within the United States and U.S. territories. Message delivery is limited to U.S. and Canadian phone numbers.

Compliance Built-In

We handle TCPA compliance so you don't have to worry.

  • Automatic Opt-Out Processing: STOP, UNSUBSCRIBE, CANCEL keywords
  • Consent Tracking: Timestamped with IP address logging
  • Mandatory Opt-Out Instructions: Auto-included in all messages
  • Carrier Registration: All campaigns properly registered

Payment Terms

  • Invoice Due Date: Net 30 days
  • Late Payment Fees: 1.5% per month after 30 days
  • Suspension for Non-Payment: After 15 days past due
  • Refunds: Non-refundable except for our technical errors

Limitation of Liability

  • THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES
  • WE ARE NOT LIABLE FOR MESSAGE DELIVERY FAILURES BEYOND OUR CONTROL
  • WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE LAST 12 MONTHS

Account Termination

We may terminate your account immediately for:

  • Illegal activity, fraud, or spam
  • Intentional TCPA/CAN-SPAM violations
  • Security breaches or hacking attempts
  • Sanctions violations

Dispute Resolution

  • Governing Law: State of Michigan, USA
  • Arbitration: Binding arbitration in Saginaw, Michigan
  • Class Action Waiver: Disputes resolved individually
