Purpose
This Acceptable Use Policy ("AUP") outlines the rules for using DialYourCalls services. By using our platform, you agree to comply with this policy. Violations may result in account suspension or termination.
Prohibited Content
You may NOT use our services to send or distribute:
- Spam: Unsolicited bulk messages without proper consent
- Phishing: Attempts to obtain sensitive information through deception
- Malware: Viruses, trojans, or malicious links
- Illegal Content: Content that violates any applicable law
- Fraud: Deceptive schemes or scams
- Harassment: Threatening, abusive, or harassing messages
- Hate Speech: Content promoting discrimination or violence
- Adult Content: Sexually explicit material without proper consent
- Counterfeit Goods: Promotion of fake or pirated products
- Controlled Substances: Illegal drug promotion or sales
Prohibited Activities
You may NOT engage in the following activities:
- Sending messages without obtaining proper consent (TCPA violation)
- Ignoring opt-out requests
- Spoofing caller ID or sender information
- Impersonating another person or business
- Using false or misleading message content
- Exceeding rate limits or system abuse
- Attempting to hack or compromise our systems
- Reselling our services without authorization
- Using our services to contact numbers on the National Do-Not-Call Registry without proper exemption
Consent Requirements
For marketing messages, you must:
- Obtain prior express written consent before sending marketing SMS
- Clearly identify yourself or your business in all messages
- Include opt-out instructions in every message
- Honor opt-out requests immediately
- Maintain records of consent for at least 5 years
- Respect quiet hours (before 8 AM and after 9 PM recipient local time)
Industry-Specific Rules
Financial Services (GLBA)
Must comply with Gramm-Leach-Bliley Act requirements for customer information security.
Healthcare (HIPAA)
Protected Health Information (PHI) may only be transmitted with proper safeguards and patient authorization.
Debt Collection (FDCPA)
Must comply with Fair Debt Collection Practices Act restrictions on contact times and content.
Enforcement
Violations of this policy may result in:
- Warning: First-time minor violations
- Temporary Suspension: Repeated or moderate violations
- Permanent Termination: Serious or repeated violations
- Legal Action: For illegal activities or significant damages
We reserve the right to terminate accounts immediately for severe violations without prior warning.
Reporting Abuse
If you receive spam or abusive messages sent through our platform, or are aware of policy violations, please report them to us. We investigate all reports and take appropriate action.
